The Shin Bet and the IDF have released 50 Gazan detainees, including Muhammad Abu Salmiya, the director of Shifa Hospital, who had been held in administrative detention since November 23. Despite suspicions that Hamas used Shifa Hospital for terrorist activities, no concrete evidence was presented linking Abu Salmiya to these actions. His detention was based on suspicious answers he gave during questioning, but without solid evidence, it is usually insufficient to justify extended administrative detention.
Abu Salmiya had three court hearings, with his detention extended during a video conference with an Israeli civilian magistrate’s court in December 2023 and again in the spring of 2024. Since then, there have been no updates on his status. The high number of detainees and the ongoing war have delayed legal processes.
Despite his detention, Abu Salmiya was not indicted due to a lack of specific evidence. His release, along with other detainees, has sparked political accusations and controversy in Israel. Prime Minister Netanyahu and Defense Minister Yoav Gallant denied knowledge of the specific detainees being released, while the Shin Bet has faced political criticism for its handling of detentions.
Israeli law generally requires filing an indictment within a set period to justify detention, but this was not met in Abu Salmiya’s case. Upon his return to Gaza, Abu Salmiya described the prison conditions as harsh and called for the release of prisoners.
According to our sources, the recently released director of Shifa Hospital has provided crucial and “game-changing” information. This includes details on the last known locations of senior Hamas officials in Gaza and potentially the exact whereabouts of senior Hamas figures abroad (such as in Lebanon and elsewhere).
The security establishment regards this information as invaluable, believing it will significantly aid in the defeat and destruction of Hamas. It is likely that elements within the Gaza Strip will seek retribution against the Shifa Hospital director for the information he has disclosed.
